Terms of Service
I. General Provisions
We are glad you are visiting the Celebrio platform, managed by Optimum Process sp. z o.o. (hereinafter “Celebrio”). The platform includes the website available at https://online.celebrio.app and all related services, applications, and products designed for the authorized streaming and distribution of content on the internet (“Services”). Please read the following terms carefully (“Terms”). By agreeing to the Terms – including by registering, accessing, browsing, downloading, or using the Services – you confirm that you have read, understood, and agree to be bound by them. If you do not accept these Terms, please refrain from using the Services in any form. If you are accepting these Terms on behalf of a company or other legal entity, you represent that you have the authority to bind that entity. If you are accessing the Services as an individual, you confirm that you are at least 18 years of age. For individuals who have not reached the age of majority, parental or legal guardian consent is required to accept the Terms. The terms “You” and “Your” refer to you or the entity you represent.
II. Registration for the Services
To access the full functionality of the Services, you must register an account. During this process, you may be asked to provide information such as your first name, last name, email address, phone number, credit card details, billing information, and potentially other information. If the information you provide proves to be false, inaccurate, or incomplete, Celebrio reserves the right to close your account or deny access to the Services. You may not hold more than one account per person or organization unless Celebrio has given prior written consent. The automated creation of multiple accounts is also prohibited. Celebrio undertakes to treat the above information as confidential, in accordance with the applicable Privacy Policy.
III. Right to Use the Services; Prohibited Activities
Under these Terms, Celebrio grants you a limited right to access and use the Services for personal purposes only. The following activities are prohibited in particular:
- Using any part of the Services to create or develop a product or service that is related to or competes with the Services.
- Using the Services in a manner that would cause damage, overload, impair performance, or disrupt the operation of the platform itself, Celebrio’s servers, cloud solutions, or other environments in which the Services are running.
- Using the Services in a manner that is unlawful, prohibited by these Terms, or inconsistent with applicable regulations.
IV. Third-Party Platforms
The Services allow you to upload, publish, and share your content (“Your User Content”) on selected third-party platforms to which you connect (“Third-Party Platforms”). By choosing to connect to such platforms, you agree to comply with their terms of service, rules, and policies. Celebrio is not responsible for any violations of Third-Party Platform terms on your part. By using the Services, you consent to the Services accessing your accounts on Third-Party Platforms and performing specified actions on your behalf (e.g., “connecting,” “subscribing,” “publishing,” or “sharing”).
V. User Content
You represent that you hold the necessary rights and permissions for all materials uploaded by you through the Services (“Your User Content”), and that you bear full responsibility for their legality, credibility, accuracy, and availability. You are prohibited from posting content that:
- Is illegal, harmful, vulgar, defamatory, obscene, threatening, or violates applicable law.
- Promotes criminal or unlawful activities.
- Is pornographic in nature.
- Promotes violence.
- Constitutes discrimination based on race, gender, religion, sexual orientation, or disability.
- May cause harm or injury.
- Contains advertising or marketing material.
- Does not belong to you or for which you do not hold the appropriate rights or permissions.
Celebrio does not actively monitor Your User Content but reserves the right to remove it if a violation of these Terms is detected.
VI. Fees and Payments
Certain features of the Services may be subject to fees. The applicable amounts are set out in Celebrio’s current pricing schedule published on the website. Celebrio reserves the right to modify its pricing policy and to introduce fees for features that were previously free of charge, following prior notice to users.
VII. Third-Party Providers
Celebrio relies on third-party cloud service providers and assumes no responsibility for their availability, performance, or level of security.
VIII. Intellectual Property Rights
Celebrio holds all intellectual property rights associated with the Services, including any improvements, updates, modifications, and analyses.
IX. Privacy Policy
Please review Celebrio’s Privacy Policy, available in the same document. By accepting these Terms, you also consent to the provisions of the Privacy Policy.
X. Disclaimer of Warranties
The Services are provided on an “as is” basis. Celebrio makes no warranties regarding their uninterrupted availability, performance, or fitness for a particular purpose. Celebrio is not liable for:
- Any losses or damages arising from the use of the Services.
- Viral infections, errors, or malicious software.
- Any interruptions to the Services.
- Unauthorized access to user data.
XI. Limitation of Liability
In no event shall Celebrio be liable for indirect losses, loss of profits, or loss of data. The maximum amount of any claim against Celebrio is limited to the total fees paid by you in the preceding twelve months.
XII. Modifications to the Terms
Celebrio reserves the right to modify these Terms at any time. Updated Terms will take effect 7 days after their publication, regardless of whether you have expressly agreed to them. If you do not agree with the newly introduced provisions, you should discontinue your use of the Services.
XIII. Responsibility for content and image rights
The User is fully responsible for all uploaded content, including photos and videos. The User confirms having all necessary consents from individuals visible in the materials.
XIV. License for user content
The User grants the Administrator a non-exclusive license to process, store and display content solely for the purpose of providing the Services.
XV. Access and sharing
The User is responsible for how content is shared (link, QR). The Administrator is not responsible for further distribution.
XVI. Payments
Payments are processed by external providers. The Administrator does not store full payment card details.
XVII. Data responsibility
The Administrator does not guarantee uninterrupted availability of the Services and is not responsible for data loss.
XVIII. Governing Law
These Terms are governed by Polish law.
